Abia State Governorship Tribunal adjourns to 24 and 25 of July

The Abia State governorship election tribunal sitting in Umuahia has adjourned sitting to 24 and 25 of this month for the commencement of pre-hearing.

The proposed pre-hearing into the electoral petition of the April 11 governorship election in the state which would have commenced on Monday July 13, could not take effect.

This was because the lead counsel to the first respondent, Victor Okezie Ikpeazu of the Peoples Democratic Party,PDP, Wole Olanipekun, SAN, objected to the commencement of the pre-hearing because his client had not been duly served with the appropriate notice. He maintained that the pre-trial session could not commence without compliance with paragraph 18, sub section 1 of the electoral act, which stipulates that the respondents should be duly served with the appropriate notice of the commencement of the pre-trial session.

However, reacting to that submission, the lead counsel to the petitioner, Alex Otti of the All Progressives Grand Alliancd,APGA, Akin Olujimi, SAN, stated that the notice for the pre-hearing was duly served to the first respondent as contained in form CF 007 which was tendered before the tribunal.

However, on insistence by Counsel to Okezie Ikpeazu that such notice was not recieved, the counsel to the Alex Otti agreed to serve the respondent with the notice for commencement of the pre hearing.

The case was adjourned till July 24 and 25.
