Court Restrains Judges from Swearing In Uche Ogah as Abia Governor

The Commissioner for Information, Hon. . Bonnie Iwuoha alongside the Secretary to the State Government, Eme Okoro has said the state government has obtained an order from an Abia High Court restraining the chief judge and others from swearing in Dr. Uche Ogah as the Governor of the State, following the issuance of a Certificate of Return by the Independent National Electoral Commission, INEC, in lieu of a Federal High Court Ruling.

Addressing newsmen at Government House Umuahia, Hon. Iwuoha said the injunction restrains the state Chief Judge and any other judge from swearing in the defendant according to Section 143(1)2 of the 2010 electoral act as amended, while the claimant remains in office as the Governor of the State, pending the determination of the motion on notice.

The Secretary to the State Government, Eme Okoro said due process must be followed in carrying out any court order according to the Constitution of the Federal Republic of Nigeria.

He maintained that the state government had at the receipt of the news on the Federal High Court order to vacate office, filed "a stay of execution" and "an appeal" which gave the Governor right to fair hearing pending the determination of his appeals up to the Supreme Court.

In a related development, the Peoples Democratic Party, PDP, in the state has said the state is tensed as a result of the rape of democracy which he said the state must resist at all cost. He said the actions of the powers that be to undermine the peace of the state  would be resisted.

The state Chairman of the party, Johnson Onuigbo stated this while addressing newsmen on the recent political developments in the state. 
He said the exparte motion obtained must be adhered to and expressed readiness to die for the state if the action is ignored.

According to Onuigbo, the issuance of certificate to Uche Ogah whom he said did not accept the outcome of the primaries and didn't sign the result is unholy. He added that someone cannot benefit from a process, he didn't participate in.
